End-User Licence Agreement

This is an agreement between you (the licensee) and KF Digital Typefaces AB (from here on referred to as Kanon Foundry). By buying, downloading, installing, using, or otherwise handling the digital typeface software (hereafter fonts) you accept the terms of this agreement. By accepting the terms of this agreement you confirm that you understand and will comply by its terms. This agreement replaces and overrides earlier vocal and written agreements made between you and Kanon Foundry unless noted.


If you act on behalf of the end-user:

  • You are not allowed to ask for a different price other than the one offered by Kanon Foundry.
  • You must guarantee that the end user agrees to the terms of this specific EULA.
  • You are not allowed to use the fonts.

General

Copyright

The font provided upon purchase by Kanon Foundry is copyrighted and contains intellectual property information protected by Swedish law, by the copyright and design laws of other nations, and by international treaties. Any copyright, trademark, and other rights belong to Kanon Foundry.

When purchasing a font from Kanon Foundry you become a licensed user, not an owner of the font. The font will remain copyrighted to Kanon Foundry and its creators. You don’t buy the copyright to the design or any other part of the font, you buy the right to use it according to the specifications in this agreement.

Warranty & Refunds

All purchases from Kanon Foundry are final, and we give no refunds unless the customer can prove within 30 days after purchase that the font is not working as specified by us.

In that case, Kanon Foundry will do their best to fix the problem and provide the licensee with a font that lives up to our specifications. If Kanon Foundry are not able to resolve said problem within 30 days after they’ve been informed about it the customer will be given a refund. After a refund, the license will be terminated, and further use is forbidden.

Termination

Any failure to comply with the terms and conditions of this agreement terminates your license with immediate effect. Upon termination, you must destroy all copies of the fonts, modified versions (if any), and archived copies.

Liability

Kanon Foundry shall not be liable for any direct, indirect, consequential, inconsequential, or incidental damages, including the damages from loss of business profits, business interruptions, and loss of business information arising from the use or inability to use the fonts.

Governing law

This license shall be governed by and construed under and in accordance with the laws of Sweden.

Dispute resolution

Any action or proceeding against the licensee or Kanon Foundry related in any way to this license shall be resolved exclusively by the Swedish general court.

Changes in the EULA

Kanon Foundry reserves the right to update this EULA at any time. If updates will occur they will be announced at www.kanonfoundry.com where the updated EULA will be published for the public.

Desktop Licence

Allowed uses

A desktop license allows the user to install the font onto a specified number of computers. You can use the font in Desktop Publishing software (DTP) to create materials such as— but not limited to: logotypes, typographic layouts, posters, books, business cards, etc.

This material can be used to create images on computer screens, paper, websites, clothing, and mobile apps as long as they are rendered in a fixed size as either raster(JPG, PNG, TIFF, etc) or vector(EPS, PS, PDF) images as long such files are used only by the organization/customer licensing the font.

Number of users

The number of users allowed to install the font should be defined when the fonts are purchased, and specified in the receipt provided upon purchase. If the organization/ customer later on would need a license that covers further users a complimentary license must be purchased. All users need to be part of the same company, organization, or household purchasing the license.

Third parties

Sharing licensed fonts with third parties is not allowed under any circumstances except for situations when artwork should be handed over to a prepress bureau or a printer. This is only if they agree to the EULA and on using the fonts specifically for the projects they were intended for.

Embedding

The licensee is allowed to embed the font into the following file formats: PDF(Portable Document Format), PS(PostScript), and EPS(Encapsulated Postscript). The font can and must not be embedded into any other format.

Modification

Modifications, conversion, or re-naming of the fonts are not allowed under any circumstances. All and any modifications must and can only be exclusively executed by Kanon Foundry. Please contact info@kanonfoundry.com for further requests and information.

Web Licence

Allowed uses

A Web License allows you to use the licensed web font(s) on any website that is owned or runs under your control, under a particular domain name.
The web font(s) may be used in a website where text can be edited and styled by using a licensed web font. The licensed web font(s) can also be used in newsletters as long as the total amount of visitors and readers (of the newsletters) included does not become greater than the total amount of visitors per month stated during the purchase.

The licensed web font(s) may not be used to create styled content outside of the website it was purchased for, including but not limited to, PDF documents, image files, or any physical objects.

Number of users

The license for a web font serves a specific amount of visitors per month. The total amount of visitors per month for a website on which the licensed web font(s) is used must not be greater than the number of visitors per month the licensee has stated during the purchase. The licensee is held responsible to state an accurate amount of visitors per month.

Studios responsible for several clients’ websites, such as web design studios, can not use a single webfont license for multiple clients’ websites.

File handling

The use of webfont(s) on devices within your organization is restricted to the development of the websites it is licensed and purchased for. Activities like these are usually referred to as “web development”. If the organization uses a third party for their web development a copy of the web font(s) may be sent to this third party, if they agree to the EULA and on using the fonts specifically for the projects they were intended for.

Embedding

No other embedding technique than CSS @font-face is allowed to use when using the licensed web font(s). The web font(s) should therefore never be embedded in any other formats. It is not allowed to use the web font(s) to create raster or vector images.

Conversion and Modification

Conversion, modifications, or re-naming of the web font(s) are not allowed under any circumstances except subsetting of the character set. You may not under any circumstances modify the design of the licensed web font(s), or its font name tables. This applies to all published, unpublished, and released fonts by Kanon Foundry.

App Licence

Allowed uses

An app license allows the user to embed the licensed font into any number of computer/mobile/game applications created by the licensee’s household/organization by a specified number of developers. Studios responsible for several clients’ apps can not use a single app license for different clients’ projects.

The licensee may use a Software Development Kit (SDK) to style text that is part of the application’s Graphical User Interface(GUI). Using the licensed font to create raster(JPG, PNG, TIFF etc) or vector(EPS, PS, PDF etc) images containing the font is not allowed.

Number of users

The number of installations of the app depends on the number of people who downloads and installs the app, this number should be defined when the font(s) are purchased and specified in the receipt provided when purchasing the font. If the number of user installations of the app would later on increase the organization/company need to purchase a complimentary license that covers further app installations.

Third parties

If the organization uses a third party for their app development a copy of the fonts may be sent to this third party if they agree to the EULA and on using the fonts specifically for the projects they were intended for.

Embedding

Embedding the licensed font into files other than an application is not allowed.

The fonts are provided in OTF and TTF formats. Modifications, conversion, or re-naming of the fonts are not allowed under any circumstances. Trial Licence

General

The trial fonts provided by Kanon Foundry are exclusively for the purpose of testing the fonts before licensing them, and for mockups in paid and unpaid pitches.

Allowed uses

A trial license allows the licensee to install the font onto their computer within the organization or family, with the purpose of testing, comparing, or presenting it to a client. The licensee is allowed to use the trials exclusively for these purposes.

In order to use the fonts in final artworks, one must buy and obtain the full license of the font, either the desktop, app, or web license depending on the purpose.

Third parties

Sharing trial fonts with third parties is not allowed under any circumstances.

Modification
